about what they were doing about filing the Temporary Restraining Order
Injunction, As my friend Jerry was here helping to advise & discuss
too – and it turned out, In the end, the reason they ultimately got
evicted, was because their Dingy Lawyer FAILED TO SERVE THEM!! Yep,
She failed to even serve the mayor or the police – and she efiled the papers
for a TRO/Injuction Into the court the day of, where the judge didn’t get
them until the next day after the eviction took place, so there was nothing
he could do!!!
They will likely try to cover this up. Jerry firmly believes that this lawyer was working for the other side, like a spy, getting paid by the mayor. I’m not joking, as he says it’s impossible that she wouldn’t have been there to serve those papers unless she was a trader!!! Because she knew what was going on - So I absolutely let her have it on the chat for her incompetence, I told her directly & to the chat group, that this attorney group should not be used again for anything with that Occupy movement – to us, this seemed like a regular episode for Jesse Ventura’s Conspiracy Theory show!!!
Further, days before the eviction notice was posted, just that Friday, I told the dingy occupiers to go to the court around the corner and file for this TRO for free on a fee waiver through the self help center. I warned them to not trust any lawyers to get anything done for them, (I KNOW BETTER!) and that they had nothing to lose in trying to file something, there could always be more filings and filings can always be dropped – and as they are all camping out sleeping right next to the court house, it would be easy to try and File something.. but noone did, as I was further attacked for even suggesting this, as they told everyone not to file anything on the occupiers behalf, that it should go through this 1 attorney whom a few decided upon.
And they were told she was amongst the best in the country, lol, yeah
right, As meanwhile, my fellow was
questioning what was Up with this lady all along, saying she needed
to go back to law school !! And it turned out, apparently so! And They
were filing for all kinds of reasons using city law & califorina law
– but Jerry kept telling them to use US constitution law in a federal court,
as Tennessee case set precedence for it because they already won the case-
Based on the fact that the citizens own the public property and can be
on it anytime, etc – nothing in the constitution Says otherwise… but the
lawyer was making excuses for why that case was different – I think even
if she served the Mayor, she still might have lost the case, dingy lawyer..
But anyhow, I also suggested again to the occupiers to consider legal shield by prepaid legal for protection – But nobody wanted to give up $17 to try it out for the month – meanwhile, 300 of them went to jail after 1400 cops Raided them at 3am, forcing them to leave, and put them in jail with a $5000 bail that has been lowered to $2000 per person now, but they are all broke so they remain in jail until next week when they have an arraignement, where they will probably be released. (Now they are thinking about the $17, of course. Lock the barn door after the horse is gone.)
LATER: I am told that any one of those Occupiers camped out in LA could
have basically printed up this attachment And served it to the police when
they came to Raid them!!! And it could have stopped the Raid!! So I
don't know --- but the fact is, nobody even tried --- nobody served
them - & as the Occupiers were told they would be evicted if they weren't
out by Monday, (legal or not) nobody took legal Action in time to stop
it!!
So right or wrong, a Raid was to be expected ?! Everyone there followed
the chat group, and so we thought the TRO was filed, because it was posted
--- But we feel that had we been camped out there, We sure as heck would
have had a copy of this TRO filing (attached) with us in our back pocket,
in case the police did Come to raid, we could officially serve them ourselves,
and tell them how we filed with the court --- who know what would have
happened --- but if you don't serve them the papers, you don't know - And
as the Raid happened at 3am we weren't there to advise & apparently
none of the campers thought of This.. and the lawyer was nowhere to be
found, apparently --- Me & Jerry blame the lawyer as we feel she should
Have been with them and/or on call to serve them or handle such a mix-up
--- therefore, we feel that she was in on the raid, working for the otherside,
because she did nothing --- Understand I've been in Vegas during all this,
communicating with them on a chat ---I have had my own work issues, etc,
Were I couldn't physically be there -
And yes, the ding-ey chat group doesn't listen to anyone who tries to
post ideas to help, etc- they get defensive and They don't trust anyone
or anything --- they think everyone is out to get them or something ---
So yes, if an offer was made, as you say, for office space ---it wouldn't
surprise me if they turned it down, the Way they have
been childishly behaving --- they should take what the universe gives
them and realize it is a step! All the changes cannot happen over night..
Yes I feel they need to try to work with the legal system first, before
all this raid non-sense, etc --- Ask & you receive, The law is on their
side, the 99% people, but we need to claim it --- The lawyer still has
some decent attached arguments That may have gone through and order granted,
we just offered suggestions as we felt we should have mimicked exactly
What Tennessee did because they were successful --- the lawyer refused,
twisted logic ---yes this LA group uses pot logic In any case, even what
she filed here did not have a chance to be tried with the judge because
it was filed to Late --- so we question if it was deliberate, Jerry
thinks it was.
I could inquire about office space if I make the Vegas meeting tonight & report back Bill, good idea --- a free indoor Office beats being out in the cold??
Yes the police could have handled things better -- in fact a policeman
is a citizen like the rest of us, and could Have filed it too or done any
number of things to help --- but at the same time, the lawyer and occupiers
didn't help the Police to help them, by doing nothing legally to stop the
eviction. A policeman just follows orders --- if
they showed them The filing from the court, perhaps they would have
seen it as court orders to not raid --- this is my thought, its what I
Would have done if I had been there.
Further, if I was still there when they raided at 3am, I would have packed up and walked away at that moment versus Getting arrested and going to jail --- I am not sure I see the point? It seems many of them do this thinking it will attract Media attention to help Occupy? Again, pot logic Tim, I don't think it served them inn the media? Just makes it look like a circus & drama, etc?
They didn’t want prepaid legal , maybe afraid someone would profit, selling it to them – I said well, the alternative is paying hundreds of Dollars to the court to bail you out, a government entity again in power over you which is why you are here protesting in the first place!!???
